Please read these Terms in their entirety before attending The Event. Your access to and use of The Event is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all guests, users and others who register and/or attend The Event.

These Terms of Use (“Terms”) govern your access to The Event (“The Event,” “Company,” “we,” “our”) and the use of our websites, services, and applications (collectively the “Site”). The Site includes but is not limited to www.thepj.party and all of The Event’s social accounts.

By registering and/or attending The Event or participating across The Event’s blogs, online forums, and social media platforms etc., you are agreeing to abide by the following Terms.

You may register and/or attend The Event only if you can form a binding contract with The Event and only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations. The Site and/or The Event may change its policies and features from time to time, often and without prior notice to you. In addition, The Event may temporarily or permanently stop providing the Site and/or The Event without prior notice.

Code Of Conduct

The Event is not a place for behaviour that is inappropriate, off-topic, disruptive, abusive, or illegal.

The Event defines inappropriate behaviour as that which undermines the spirit of The Event, including any form of written, verbal or physical abuse or threats, the use of derogatory or discriminatory language, gestures or actions, any form of harassment, racism, sexism, or any other targeted comments which may violate any local, state, federal or national laws, or cause harm to another Event guest before, during or after the Event, whether in-person in, through social media channels, while engaging in any online aspect of the events, or any other method of communication.

The Event may take action in its discretion to address any individual(s) or group(s) it believes fail to meet the standards set forth in this Code of Conduct, including, without limitation, revoking the violating parties’ credentials without refund.

During in-person events, The Event expects that all attendees of our events follow public health guidelines related to safety, and hygiene including, without limitation, social distancing, hand washing, staying home if you are sick, and other disease prevention measures.

Please contact info@thepj.party if you believe you’ve observed or experienced a violation of this Code of Conduct, and The Event will work to assess the situation and respond as soon as possible. Notifying The Event does not constitute or replace a notification to local law enforcement or emergency services.

Photo/Video Waiver & Release

By registering and/or attending The Event, you agree to the following terms:

  • I hereby consent to and authorize the use and reproduction by The Event of any and all photography and/or videography that has been taken of me this day for any purpose without compensation to me.

  • All digital images and/or video files are wholly owned by The Event, who reserves the right to use these images and/or videos.

  • I hereby grant permission to the rights of my image, likeness and sound of my voice as recorded on audio or video without payment or any other consideration. 

  • I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. 

  • Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording.

Opting Into Communications

Connecting with The Event

By registering and/or attending The Event, you are opting in to our communications, you are giving The Event permission to share the latest news about The Event and related offerings with me by email and telephone. You may unsubscribe from receiving The Event news and offers at any time by following the instructions in the communications received. The Event handles your information as described in The Event Privacy Notice.

Connecting with Sponsors

By using The Site and/or attending The Event, you are opting into any communications. You are giving The Event permission to provide your contact information to The Event Sponsors (The Sponsors). If you choose to enter The Event, The Sponsors may send you news and offers by email and telephone. You may unsubscribe from receiving news and offers from The Sponsors at any time by following the instructions in the communications received. The Event handles your information as described in The Event’s Privacy Policy. Providing The Event or The Sponsor with your information may involve transferring it to another country. For questions about how The Sponsor will handle your information, please contact The Sponsor directly or refer to The Sponsor’s privacy policy.

Site Visitors and Guests

To attend The Event, particpate in the Raffle or purchase products sold at The Event, you must be at least 18 years of age. By attending The Event, you represent and warrant that you are at least 18 years old and that all information you submit is accurate and truthful. The Event may, in its sole discretion, refuse to allow access to or use of the Site or The Event to any user or guest.  This provision is void where prohibited by law, and the right to access the Site is revoked in such jurisdictions. You agree to comply with all laws regarding conduct. In addition, you must abide by The Event’s Code of Conduct and its policies as stated in these Terms and other policy documents listed on the Site, as well as all other operating rules, policies and procedures that may be published from time to time on the Site by The Event and each of which may be updated by The Event from time to time without prior notice to you.

Terms of Sale

If you elect to subscribe to our services or purchase a ticket to The Event, you shall pay all applicable fees as described on the Site or associated documentation.  Fees may be displayed exclusive of state and local sales and may incur taxes or duties imposed by taxing authorities. You shall be responsible for payment of all such taxes.  You agree to pay any such taxes that might be applicable to your use of the services and payments made to The Event. The Event reserves the right to change prices at any time, and any such changes or modifications shall be posted on the Site and effective immediately (notices to any user are at the discretion of The Event).

Third-Party Advertising

The Site may contain links to third-party websites, advertisers, or services that are not owned or controlled by The Event. We cannot control, and we assume no responsibility for, the content, availability, privacy practices, or business practices of any third-party websites or resources linked to or referenced on the Site. The Event does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources.  You agree that The Event shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or resources. Your dealings with any such third-party websites are solely between you and those third parties.  If you access a third-party website from the Service, you do so at your own risk, and you understand that these Terms of Use and other The Event policies do not apply to your use of such websites.  We encourage you to be aware of when you leave the Site and to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Resolution of Disputes and Release

In the event a dispute arises between you and The Event, please contact The Event. For all purposes of these Terms, the parties consent to exclusive jurisdiction and venue in Bermuda. You hereby waive any right to assert the doctrine of forum non-conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this paragraph. Use of the Site is not authorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.  You and The Event agree that any cause of action arising out of or related to the Site or these Terms must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred. Should you have a dispute with one or more users, or an outside party, you release The Event (and The Event’s officers, directors, agents, subsidiaries, joint ventures, and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. The Event encourages users to report user-to-user disputes to their local law enforcement, postmaster general, or a certified mediation or arbitration entity, as applicable.

Intellectual Property

Unless otherwise noted, all of the text, information, data, graphics, photographs, images, illustrations, animations, software, audio, video, and all other content on the Site (collectively, the “Content”) is subject to the copyright and other intellectual property rights of The Event.  All Content on the Site is the sole property of The Event The Event reserves all rights not expressly granted in and to the Site and the Content.  Subscribers on the Site are granted a limited, non-exclusive, revocable license to use the software provided on the Site for the sole purpose of online learning. This limited license shall remain in effect until your subscription (unless otherwise stated) is terminated as provided in these Terms.  You agree not to engage in any use of the Content other than as expressly permitted by The Event The software and other The Event Content may not be copied, distributed, modified, or reproduced in any medium or for any purpose without express written permission from The Event  You agree not to circumvent, disable, or otherwise interfere with security-related features of the Site or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Site or any of the Content therein.

“The Event” and other trademarks, trade names, graphics, logos, domain names, designs, page headers, button icons, service names, and any other features of The Event brand (collectively, the “Trademarks”) are the sole property of The Event. These Terms do not grant you any license or right to use the Trademarks for any purpose, whether for commercial or non-commercial use. The Event’s Trademarks may not be used except as expressly permitted by The Event.

Disclaimer of Warranties

The Event makes no representations or warranties as to your attendance at The Event. It assumes no liability or responsibility for the accuracy, or any error or omission, in the Content. We do not represent or warrant that attendance at The Event by you will not infringe on the rights of third parties.  Third parties may provide some of the content available on the Site.  The Event does not guarantee the accuracy, integrity, or quality of the content provided by third parties. Neither we, nor any of our affiliates, nor any of our employees, agents, content providers or licensors, make any representation or warranty of any kind regarding the Site or the Site content whatsoever. You acknowledge that you are using the site at your own risk. The Event, its officers, directors, employees, affiliated, and suppliers provide the site and The Event’s services “as is” and without any warranty or condition, express, implied or statutory. The Event and its officers, directors, employees, affiliates, and suppliers specifically disclaim any implied warranties of title, merchantability, performance, fitness for a particular purpose and non-infringement. No advice or information (oral or written) obtained by you from The Event shall create any warranty. Some Countries do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. You may also have other legal rights that vary from state to state.

Limitation of Liability

In no event shall The Event and (as applicable) The Event’s staff, volunteers, sponsors, directors, employees, affiliates, or suppliers be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with your attendance at The Event, The Event’s services, or these Terms, including without limitation, lost profits, bodily injury, emotional distress, or any special, incidental or consequential damages.

Indemnity

You agree to indemnify and hold The Event and (as applicable) The Event’s staff, volunteers, sponsors, directors, employees, affiliates, or suppliers harmless from any claim or demand, including attorney’s fees, made by any third party due to or arising out of your breach of these Terms or other company policy documents, or your violation of any law or the rights of a third party.

Severability

If any provision of these Terms is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of these Terms shall remain in full force and effect.

Company of Service

The Event reserves the right to modify or terminate the Site, The Event and any services for any reason, without notice, at any time. The Event reserves the right to alter these Terms or policies at any time.  Each revised version of these Terms will be posted on the Site. Attendance at The Event constitutes your acceptance of any revised Terms.

Choice of Law

All disputes arising out of or in connection with the present contract shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with said Rules.

Survival

Any and all provisions in these Terms relating to fees, service, content, licensing, information control, dispute resolution, The Event’s intellectual property, data access and site interference, breach of these Terms, privacy, warranty, limitation of liability, severability, the relationship(s) between and among The Event, Site users, and third parties, and choice of law, survive any termination or expiration of these Terms.

Notices

Except as explicitly stated otherwise, any notices shall be emailed to The Event, Attn: Legal Notices (in the case of The Event) or, in your case, to the email address you provide to The Event. Notice shall be deemed given 24 hours after the email is sent unless the sending party is notified that the email address is invalid.  Alternatively, The Event may give you notice by email, postage prepaid and return receipt requested to the address provided to The Event In such a case, notice shall be deemed given three days after the date of mailing.

Information We Collect

The Event uses the information we collect to:

  • Provide services for our guests

  • Improve the Site, services, and usability

  • Communicate with our guests

  • Share guest stories and experiences publicly

Personally Identifiable Information: We may collect personally identifiable information that you voluntarily provide to us when you purchase products or services through the Site, create an account, and/or contact us for customer service purposes. The types of information that may be collected include name, address, email address, telephone number, t-shirt size, age, country of origin, salary info/goals, IT certification/experience info, IT interest areas, guest goals/interests/dream job/aspirations, guest referral info, guest sign-up date, guest product/service purchase details, payment history, training progress data, current guest employment status info/details, and, as applicable, billing information.

You provide certain personally identifiable information to us when you register your email address with us for mailing lists or other Site services and/or when you send email messages, submit forms, or transmit other information. If you correspond with us via email, we may retain the content of your email messages, your email address, and our responses. If you pose questions about our services, we may incorporate those questions onto an FAQ page to improve the Site experience. Still, we will not divulge personal identifying information such as your name or email in that case.

Any additional voluntarily provided information may include testimonials, product reviews, and other information provided when guests participate in review boards, discussion boards, chat sessions, mentor sessions and coaching calls, and/or other interactive areas of the Site and its services.

Guest Rights: Our Privacy Policy is in compliance with GDPR (General Data Protection Regulation), and our guests have the following rights regarding their data:

  • To have personal data deleted or removed

  • To restrict/block/suppress the processing of personal data

  • To retain and reuse personal data for their own purpose

  • To object to personal data being used for the purpose of direct marketing or advertising

  • To have their personal data rectified if it is inaccurate or incomplete

  • To be informed about how personal data is being used

  • To have knowledge about what guest data is being stored and how it is being processed

  • To be protected against the risk of potentially damaging decisions made without human intervention (e.g. automated processing by a third party that affects you as a guest of the Site)

Information we collect automatically

Cookies: When you use the Site, we may send one or more “cookies” – a small data file – to your computer to uniquely identify your browser and let The Event help you log in faster and enhance your navigation through the Site. A cookie may convey anonymous information about how you browse the Site to us. A persistent cookie remains on your hard drive after you close your browser so that it can be used by your browser on subsequent visits to the Site. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Site may not function properly if the ability to accept cookies is disabled.

Log Files: When you use the Site, our servers automatically record certain information sent by your web browser. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Site, domain names, landing pages, pages viewed, mobile carrier, and other such information.

Local storage: We store data locally on your device to enhance the guest experience on our site. Browser local storage allows us to save what page you are on, and what lesson progress you have made so that when you return at a later time or refresh the browser, the page will remain the same.

 Third-Party Tools: The Event uses third-party analytics tools such as Google Analytics, marketing automation and customer service tools. Many of these tools collect the information sent by your browser as part of a web page request, including cookies and your IP address. These tools also receive this information and their privacy policy governs their use of it. When you use the Site, a third-party tool may also employ clear gifs (also known as web beacons), which are used to track online usage patterns. Geo-location information may also be collected by a third-party tool that we use, such as Intercom. The information is used to enable more accurate reporting and make The Event better for our guests. Again, these tools' use of this information is governed by their privacy policy.

How we use the information we collect

We do not use any data disclosed from our guests to make automated decisions such as for credit scoring, loan screening, profiling guests or making employment decisions.

General Operation of the Site: We use the information you submit to operate, maintain, and provide the features and functionality of the Site or otherwise in connection with our business in relation to the Site. If you provide an email address, it may be used to send you information, company news, updates, and/or related product or service information. You may unsubscribe from emails at any time by using the unsubscribe link in the email you received from us or by contacting us using the contact information provided herein or on the Site.

Non-private Communication Channels: Any information you voluntarily submit to the Site’s non-private communication channels (for example, if you submit a discussion question to our discussion boards) becomes available to other guests of the Site and potentially the public. Even if you remove the content, copies may remain viewable in cached or archived pages if other guests have copied or stored your content.

Business Mergers and Transfers: As we develop our business, we may buy or sell assets or business offerings. guests, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such information in the event of bankruptcy, merger, or acquisition.

Information Provided to Law Enforcement: We may also be required by law enforcement or judicial authorities to provide personal information to the appropriate governmental authorities. We will disclose personal information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful.

Your Use: We will display your personal information on your profile page and elsewhere on the Site according to the preferences you set in your account. Any information you choose to provide should reflect how much you want others to know about you. Please consider carefully what information you disclose in your profile page and your desired level of anonymity. You can review and revise your profile information at any time. We may also share or disclose your information with your consent, for example, if you use a third-party application to access your account (see below).

Third-Party Services: We may share your information with a third-party application with your consent, for example, when you choose to access our Site through such an application as logging into the Site using LinkedIn.

Service Providers, Business Partners, and Others: 

The Event may share your personally identifiable information with other third parties for the purpose of providing the Site to you. If we do this, such third parties' use of your information will be bound by this Privacy Policy. We may also store personal information in locations outside the direct control of The Event(for instance, on servers or databases co-located with hosting providers).

Non-Personally Identifiable Information: We may disclose your non-private, aggregated, or otherwise non-personally identifiable information, such as anonymous usage data, etc., with interested third parties to help them understand the usage patterns for the Site.

How We Protect Your Information: The security of your information is important to us. When you enter sensitive information as part of our service, we encrypt the transmission of that information using secure socket layer technology (SSL).

The Event uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information once we receive it. No method of electronic transmission of storage is 100% secure, however, and we cannot ensure or warrant the absolute security of any information you transmit or store on the Site.

Unless you opt-out by contacting us, The Event will share those who are interested in a new career with employers and enterprises attending The Event.

In the event that personal information is compromised as a result of a breach of security, The Event will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy or as otherwise required by applicable law.

Children’s Privacy

Protecting the privacy of children is very important. Our Site and services are not directed to persons under the age of 18, and The Event does not knowingly collect or solicit personal information from anyone under the age of 18 or knowingly allow such persons to register to our Site or services without parental consent. Purchases or access to The Event’s products and services are only available to persons over the age of 18. The Event guests may be asked to verify their age when purchasing The Event products and services.

Miscellaneous

This Privacy Policy, and all claims or issues regarding our site, shall be governed according to the laws of Bermuda, without giving effect to any conflicts of laws principles. Except as otherwise required by law, any legal action concerning this Privacy Policy or our site must be brought within one (1) year after the claim or cause of action arises and must be brought in Bermuda. You hereby waive any argument that any such court does not have jurisdiction over you or such dispute or that venue in any such court is not appropriate or convenient. If any part of this Privacy Policy is deemed invalid or enforceable, the remainder of this Privacy Policy shall continue in effect. Any failure to insist upon strict enforcement of this policy shall not be construed as a waiver of any provision of right contained in this policy. The Event shall have the right to reference or feature the subscriber’s name, job title, and company in its marketing materials.

Your Acceptance of This Privacy Policy

By using the Site, you signify your assent to this Privacy Policy. If you do not agree to this policy, please do not use the Site. We reserve the right to change, modify, add, or remove portions of this policy at any time. If we change our privacy policy, we will post those changes on this page. Please check this page periodically for changes. Your continued use of this site following the posting of changes will signify your acceptance of those changes.
